Refund Policy for Events

If you are unable to attend an event you've registered for, please contact us at info@baylandscaping.net or call the office at 989-893-0000 as soon as possible. 

 

Our Limited Warranty and Terms

Plant Guarantee. All plant materials are guaranteed to have been in a healthy growing environment and be free of defect and disease when they leave our nursery. Bay Landscaping will replace, once, at no charge, any plants purchased and installed by us for a period of one year after the date of planting provided they have had adequate care and have not been damaged. Bay Landscaping does not make any warranty with respect to plants that have been damaged due to neglect or abnormal weather conditions (e.g. extreme winter or summer temperature, flood, tornado, drought, or other natural disaster), fire, vandalism, theft, animals, lack or excess of moisture, or other factors beyond our control. We limit our warranty to the price you paid for the plant. Plants not sold by Bay Landscaping, but planted or transplanted by us per your request, carry no guarantee for transport or survival.  Exclusions to this guarantee include:

  • Annuals, vegetables and plants in planter boxes, pots, or other containers

  • Any plants, shrubs or trees which have not been given reasonable care or any instance in which a product has been improperly used on plants

  • Plant material on site transplanted by Bay Landscaping

  • When the statement has not been paid in accordance with company policy (see payment terms)

  • Any discounted sales


This warranty shall be void if any invoice or statement is not paid in accordance with the Payment Terms set forth below.

Payment Terms

Full payment is due at the time of completion of the work. If payment is not received within 30 days after the invoice date, a finance charge shall be added to the balance based on the principal balance at a rate of 1.5% per month. In the event said finance charge exceeds the maximum amount recoverable by applicable law, then the finance charge shall be limited to the maximum amount recoverable by law. In the event the account is placed for collection, Bay Landscaping will be entitled to collect costs and reasonable attorney fees occasioned thereby.
